    摘要:

    定价算法既能提升企业或商家的整体表现,又能改善消费者的福利。但是,定价算法在经济生活 领域的广泛应用也会产生侵犯消费者隐私、损害消费者自由和自主、使消费者遭受不公正对待以及损害消费者尊严等问题。有效预防定价算法的伦理风险,规制定价算法的路径在于:一是国家相关部门为定价算法的设计和合理使用创造良好的外部制度环境;二是使用定价算法的企业或商家所在的平台尤其是平台管理者要为定价算法制定合理的使用规则;三是加强算法设计者的道德教育及执法人员、监管人员和消费者的科技教育。

    Abstract:

    Pricing algorithm can improve both the overall performance of a company or business and the welfare of consumers. However, its widespread application in economic life can also give rise to problems such as violating consumers' privacy, damaging consumers' freedom, subjecting consumers to unfair treatment, and undermining their dignity. The path to effectively regulate pricing algorithm and prevent the ethical risks it brings lies in the following: First, the relevant state departments should create a favorable external institutional environment for its design and rational use; second, the platforms on which enterprises or merchants using pricing algorithms reside, especially the platform administrators, should formulate reasonable rules for its use; and third, the ethical education of the algorithm designers as well as law enforcement officers, regulators, and consumers should be strengthened.
